Warranty & Liability
Please read this alongside our Terms. It explains what our warranty covers and, importantly, the limits of our liability.
Our warranty
We warrant our bollards against manufacturing defects in materials and workmanship for 12 months from the date of installation, and we warrant our installation workmanship for the same period. If a fault covered by this warranty arises, we will repair or replace the affected part free of charge.
This warranty does not cover fair wear and tear, accidental damage, misuse, unauthorised modification, or faults caused by failing to follow our operating and maintenance guidance.
Limitation of liability
A bollard is a physical deterrent designed to make unauthorised vehicle access more difficult. It is not, and cannot be, a guarantee against theft, forced entry, or determined attack. By purchasing and using our bollards you accept the following.
Vehicle theft
A bollard reduces the risk of vehicle theft but does not eliminate it. If a vehicle or other property is stolen, lost, or damaged - whether the bollard was in use or not - Brutex Bollards Ltd is not liable for that loss. Responsibility for securing and insuring your vehicle and property remains entirely with you.
Driving into a bollard
A bollard is a fixed obstacle. If a vehicle is driven into a bollard - by you or anyone else - Brutex Bollards Ltd is not liable for any resulting damage to the vehicle, to the bollard, to surrounding property, or for any injury. It is the driver's responsibility to be aware of the bollard's position and to ensure it is fully lowered before driving over it.
Correct use
You are responsible for operating the bollard correctly, keeping it clear of obstructions, and carrying out routine maintenance as advised. We are not liable for loss or damage arising from incorrect use or lack of maintenance.
Nothing in this policy limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. This does not affect your statutory rights.
